Commercial Real Estate Litigation

Edward Alper is an assertive advocate for his clients in both the Supreme Court and the Civil Court in New York, and the Superior Court in New Jersey, on a wide variety of issues affecting commerical property. He has represented landlords as well as commercial tenants such as restaurants, gyms, small businesses.

With regard to his representation of commercial landlords and tenants, Mr. Alper has litigated extensively in disputes over possessory rights or over rent. Where the matter involves issues other than the nonpayment of rent, the Firm's commercial landlord/tenant advocacy has typically involved holdover eviction proceedings based upon a breach of a substantial obligation of the tenancy.  Such breaches could involve issues of illegal sublet/assignment, unauthorized construction or demolition within a commercial space, insurance, zoning, fixtures and damage to property.
